Can Mut'ah be termed as prostitution?

 I will answer extremely briefly. There are three different concepts:
(a) Normal nikah, which is not time bound.
(b) The original Mut’ah according to Muslims. The only difference between this and the former is the aspect of time. Other than that there is no evidence whatsoever of there being any other difference.
(c) The Shiah concept of Mut’ah.

Now when we compare (a) with (c) in Shiah sources, we find huge differences.

Some of them are:

1. The lady in the Shiah Mut’ah is not a wife, nor is she one’s own slave-girl. Rather she is a “hired body”. The Shiah sources clearly state: إنما هي مستأجرة.

2. The lady in the Shiah Mut’ah does not inherit from the man.

3. A man can have more than 4 ladies in his Mut’ah at any given time.

4. Mut’ah terminates without talaaq, but by the passing of time.

5. If a lady was given 3 talaaqs by her husband, and thereafter makes Mut’ah, then she does not become permissible for her former husband.

6. Mut’ah is permissible with a Majoosiyah (mushrikah).

7. The Iddah after Mut’ah is not that of nikah, but that which applies if a man had to have intercourse with a hired slave-girl.

8. In Mut’ah the lady is only entitled to the amount in proportion to the days she was available for the man, as is the general principle of lease. What she receives is not mahr (bridal gift). Rather is a fee for making herself available for use.

9. By a lady committing Mut’ah, she is not considered Muh-sanah. Therefore should she be found guilty of zinaa after this, she will be lashed and not stoned to death. This also demonstrates that Mut’ah is not nikah.

10. It is permissible for a man to make Mut’ah with a married woman provided he was not made away. In fact he should not ask, lest he loses the opportunity.

11. Mut’ah with an adulteress is permissible.

12. It is permissible to make Mut’ah with a virgin on the condition that one will not break her virginity.

13. There is no Li’aan in Mut’ah, again indicating that it is not a form of nikah.

14. There is no Zhi-haar in Mut’ah, again indicating that it is not a form of nikah.

15. There is no ‘Eelaa in Mut’ah.

16. There is no nafqah (duty to provide personal expenses) in Mut’ah.

17. There is no sukna (duty to provide a home) in Mut’ah.

18. In Mut’ah it is permissible to make a condition that it will consist of just one round of intercourse.

19. In Mut’ah it is permissible to make a condition that there will be no penetration.

20. In Mut’ah Azl is permissible without the lady’s permission.

21. There is no Khulah in Mut’ah.

Again these are all from Shiah sources. This demonstrates that there is a world of difference between (a) and (c), and also between (b) and (c).
When we say Mut’ah is prostitution, we are referring to (c), which is the Shiah concept of Mut’ah. We are not referring to (b), which is the Islamic abrogated concept of Mut’ah.

Therefore there is nothing objectionable in saying: Shiah Mut’ah is prostitution.

Jafar as Sadiq did call mutah as prostitution in the books of Ahl sunnah

Can you please expound on what (legitimate) Nikah Mutah is?  I mean, back when it was permitted.  Was it just a regular nikah except it had an expiration date attached to it?  Because if that's the case, then the Shi'ite practice of so-called Nikah Mutah really falls apart.  I was under the assumption that Shi'ites merely continued the practice that was formerly allowed but eventually banned.

Not much is known about the mut'ah that was permissible during the life of the Prophet peace be upon him.

I think there are maybe one or two hadiths on its specific laws. The one that comes to mind is that Jabir said it has an iddah of fourty-five days.

The Op forgot to add the minimum timing restriction in mutah... which is none. U can do mutah even for one hour
